  • It is well-known that poor communication can result in medical errors, cause patient injuries and disrupt the continuity of care—all of which can lead to malpractice claims. Communication breakdowns can occur at any point on the care continuum, in any type of healthcare facility and between any of the “players” involved in a patient's care. Studies show communication breakdowns that affect patient safety and quality of care are more likely to occur at transition points in a patient's care. Patients and providers comment that communication problems tend to intensify when there are more providers and care settings involved in a patient's care, and there is an increase in the complexity and variety of systems in use.

  • This presentation, given by two experienced medical malpractice defense attorneys, Linda Hay and Susan Wagener both from the firm HeplerBroom, address the ways that COVID-19 is altering the malpractice landscape. Topics discussed include who can make a claim, what kinds of claims can be brought against healthcare practitioners based on COVID-19 issues, where these types of claims can be brought, and how they will proceed differently from the traditional medical negligence claim. Within that framework, the presenters discuss the fluidity of standard of care allegations in this unprecedented times, and explain that while new types of medical theories on standard of care may expand based on the novel coronavirus, both old and new defense theories can also be used to attack these new claims. One important defense in a COVID-19 related case will be the application of immunity statutes or orders, both old and new. The presenters expound on these immunities, how they work, and how they may or may not apply in claims against healthcare providers.

Finally, the program goes back to the basics of how and why time tested defense strategies for risk management are still critically important. This includes good and detailed documentation, staying up to date with reputable and required guidelines and infection control procedures, and maintaining evidence of compliance. The presenters round out the session by looking forward to more widespread use of telemedicine, as well as practical advice for the practitioner to avoid a claim.

  • When a lawsuit alleging medical malpractice goes to trial, the case is ultimately decided by a jury comprised of laypersons. This raises the question – How can a group of persons without medical training fairly decide the outcome in cases involving interpretating the standard of care or whether a complex medical procedure was properly performed? The answer is that expert witnesses provide testimony to explain the issues to the jury. Frequently, a jury’s determination as to which party’s expert was more credible will dictate the outcome of a case.

This presentation from two experienced medical malpractice defense attorneys will provide an overview of the roles expert witnesses play in this type of litigation, the issues medical experts are asked to address, and the information experts rely on to come to their conclusions. Additionally, the presentation will cover what qualities make expert witnesses successful in persuading a jury. This webinar will allow viewers to have a complete picture of one of the most important components of how medical malpractice cases are decided.
